Before Your Notarization Checklist

Identification Needed For Notarization

  • Fill and Complete and fill in all blank spaces in documents before the Notary Public arrives, but DO NOT SIGN!

  • If you have questions about how to complete the document, contact the person who drafted or requested the document. A Notary Public is unable to provide legal advice or assistance in the drafting and/or completion of documents.

  • Every signer must physically appear, be coherent, not exhibit signs of being coerced to sign, and present acceptable and non-expired ID at the time of notarization.

  • Original documents must be presented for all Copy Certifications. Vital records (birth, death, and marriage) cannot be notarized.

  • know which Notary Certificate you need, A Notary Public cannot give advice on which one to use. Examples of Certificates:

    Acknowledgment: A formal declaration before an authorized official, such as a notary public, by someone who signs a document and confirms that the signature is authentic. Also, the certificate of the officer on such instrument indicating that the document has been so acknowledged.

    Affidavit: A voluntary declaration of facts, written down and sworn to or affirmed by the declarant (“affiant”) before a Notary Public or other officer having the authority to administer an oath.

    Affirmation: The act of affirming the truth of a document, not an oath. "I solemnly affirm and declare the foregoing to be a true statement...” Note that an affidavit may appear in two forms: a sworn affidavit with oath, or an affirmed affidavit with affirmation. Each has the same legal import.

    Jurat: A certification added to an affidavit or document stating when, where and before whom such affidavit was made.

    Oath: A solemn declaration, accompanied by a swearing to God or a revered person or thing, that one’s statement is true or that one will be bound to a promise. The person making the oath implicitly invites punishment if the statement is untrue or the promise is broken.

    Protest: A Notary Public’s written statement that, upon presentment for payment or acceptance, a negotiable instrument was neither paid nor accepted.

    Verification: A formal declaration by which one swears to or affirms the truth of the statements in a document. Also, the statement of a Notary Public that the person appearing before the notary has been properly identified as being the person purported to be appearing.

All identification cards must be ORIGINAL, signer current photography, physical description, signature, and identification number.

Identification procedures are mandated by the Texas Secretary of State.

The following forms of identification are acceptable and must be present at the time of signing:

  • Texas Driver License

  • US Passport

  • Foreign Passports Stamped by US Customs

  • Inmate ID Card

The name you will be signing on the document must match or be “Shorter than” the name on your ID. An ID in your maiden name along with a marriage license evidencing your married name is not acceptable.

Example:

If the document it is requiring, the signature of John Smith and your ID says John Micheal Smith, that is acceptable.

Can I use a foreign passport as an ID?

A Texas Notary may accept a foreign passport as proof of a signer’s identity only when notarizing residential real estate transactions.

What is a Mobile Notary?

A mobile notary is a notary public that travels to various locations to perform notarial acts. The fees charged by mobile notaries tend to be higher than traditional notaries due to travel related expenses and nuances including but not limited to gas, tolls, parking, time, traffic, etc.

Do I need a witness and if so, do you provide witnesses?

In some cases, a notary cannot legally act as a notary AND witness, therefore, some documents require an additional witness to be valid such as notarizing a will.

You are more than welcome to find your own witnesses for your notary appointment.

If you cannot find witnesses, we do have staff we can bring along for an additional fee.

Can one of the signers be over the Telephone?

No. The person whose signature is notarized must personally appear before the notary at the time the notarization is performed.

May a Notary Public Determine Which Type of Notarial Certificate Should be attached to a Document?

No. A Notary Public who is not an attorney should only complete a notarial certificate which is already on the document, or type a certificate of the maker's choosing. If a notary public is brought a document without a certificate and decides which certificate to attach, that notary public would be "practicing law." However, a notary public is provided copies of sample notarial certificates with his or her notary commission. A person for whom a notarization is performed may choose the notarial certificate, and the notary may add such certificate to the document.

Should a Notary Public Rely Only on a Credit Card in Determining the Identification of a Signer?

No. If the signer is not personally known by the Notary Public or identified by a credible witness, the Notary Public must use an identification card issued by a governmental agency or a passport issued by the United States to identify the signer.

I don't have my ID. Can I show you a picture of my ID in my phone?

No. You have to present a physical ID in person. If you do not have a physical ID, you have the option of using a credible witness who does have a valid U.S. ID.

Can I come to your location?

We do not have a physical store location that you can come to. The addresses displayed in our ads and on our website are for written correspondences and mailing purposes only. Our service is strictly mobile and by appointment only.

Why do documents need to be notarized?

Many real estate, estate planning, and certain international documents must be notarized in order to have the legal effect they are intended for. A notary public’s duty is to act as a liable.

How soon can you get here? How much advanced notice is required?

In order to better serve you we request that all appointments be scheduled at least 24 hours in advance. We will, however, make every attempt to fulfill “same-day”, “last minute” and “emergency” requests.

Does a signer “personally appear” in the presence of an online notary public?

With traditional notary, signers have to personally appear in the physical presence of the notary public. In a remote online notary session, the signer and the notary do not have to be physically present with one another for the notarial act to be considered valid and legal. Instead, the signer can be considered to be legally “appearing” by audio-video conference. Because the signer can appear by videoconference, they can be located anywhere in the world during the notary session. And the notarial act will be legally valid under state law. Needless to say, this aspect of online notary makes the process dramatically faster, easier, and safer than an in-person traditional or mobile notary service.

What devices can I use for an online notarization?

Desktop computer, laptop, tablet or smart phone with stable Internet Connection; in addition you will need to access to your functioning camera and microphone on your device.

Is online notary legally recognized?

Almost all U.S. states now permit their notaries to perform Remote Online Notarization (RON), providing broad access to notarial services. If a local notary isn’t available, you can use a notary from another state where RON is authorized, thanks to the interstate recognition of notarial acts. While this opens up convenient options for individuals and businesses, it’s important to confirm with the intended document recipient or consult legal experts to ensure RON is appropriate for your specific needs. This step ensures your notarized documents will be valid and accepted for their intended purpose

What is remote online notarization?

Remote Online Notarization (RON) is a process where documents are notarized in an electronic form by a notary public using a secure online platform. This technology enables the notary to verify a signer’s identity, witness their signature, and notarize documents remotely through video conferencing. RON provides a convenient and efficient solution for document notarization, accessible from anywhere with a stable internet connection.

Will my state recognize a document notarized online?

Every US state recognizes the legal effect and validity of a document that has been notarized online as long as the notarization was performed in compliance with the laws of the notary’s commissioning state. The notary public must be commissioned and approved in a state that authorizes remote online notary under statute.

What type of documents can be notarized online?

Almost any document that would typically be notarized in person can also be notarized online, offering great flexibility and convenience. However, there are some notable exceptions to keep in mind.

Last will & testament documents – including wills, codicils, will amendments, and testamentary trusts. (Please note that we can notarize living wills.)

It’s important to verify with the recipient of your document, or consult with your attorney or advisor, to ensure that online notarization is suitable and accepted for your specific document type or legal scenario. This extra step helps guarantee that your notarized document will meet all necessary legal and procedural requirements.

How does the notary verify a signer’s identity?

Except if the online notary has personal knowledge of the signer, the notary must confirm the signer’s identity two ways: first, by validation of the signer’s photo ID; and second, presenting the signer with security questions.

“Credential analysis” is where the signer’s photo identification card (such as a driver’s license, passport, or state-issued identification card) is validated. This process uses artificial intelligence to confirm the ID’s security features and that the ID document is not fraudulent or altered. The technology also checks available information from the authority that issued the ID or from another authoritative source that the ID is current and duly issued.

“Identity proofing” is the second step in confirming the signer’s identity. Here the notary can affirm the signer’s identity with dynamically-generated questions about the signer based on public records and other proprietary data sources. The signer must answer a sufficient number of knowledge-based authentication questions within a prescribed amount of time. Examples of these types of questions (with multiple-choice answers) include the following:

“Which of these email addresses is yours?”

“What is the ZIP code for your home on Brookfield Avenue?”

“In which city did you attend college?

An increasing number of states allow their notaries to use biometric analysis instead of identity proofing questions to satisfy the identity proofing requirements.

What is the process of signing a document in an online notary session?

Join a live video call with a commissioned notary public, where they will verify your identity using your photo ID, then you will electronically sign the document on screen while the notary witnesses your signature via the video feed; the notary will then add their digital seal and signature to finalize the process.

How does an online notary keep their records?

The records of each notarial act of an online notary public are in electronic form and, saved in a secure environment and backed up. The system used by the notary also creates a digital recording of the online notary session. The recording is saved with the electronic record of the notary session. Records are required under law to be saved for a legally prescribed number of years.

Is online notary safer than traditional in-person notary services?

There are several reasons why online notary is far safer. Because the online notary session is recorded, any indications of coercion, duress, or other wrongdoing can be reviewed well after the session’s completion. With remote online notary, the signer’s identity is confirmed using a two-step process of identity-proofing questions and a technology-driven analysis of the signer’s identification card. We use technology that can instantly analyze any state’s driver’s license, state-issued ID, or U.S. Passport. This level of ID verification is all but impossible for an in-person notary to perform. Therefore, the likelihood of identity fraud is dramatically reduced. Each signed document in an online notary session is sealed with a tamper-evident digital signing certificate that allows for easy detection of any unauthorized changes to the document.
